Online Trademark Filing Service vs. Trademark Attorney vs. Hourly Law Firm: What You Actually Get
By Nuzayra Haque-Shah, Esq., California-licensed intellectual property attorney, NH Legal P.C. Updated November 2026. This is general information, not legal advice for your situation.
Short answer: a filing service is the cheapest way to submit a trademark application. A flat-fee trademark attorney is the cheapest way to get one registered without surprises, because the search, the filing strategy and the office action response are part of the price. An hourly firm gives you the same lawyering but you learn the total at the end.
The three options side by side
- Do-it-yourself filing service: about $199–$350 plus USPTO fees. You are the filer. Usually no legal advice and no attorney of record. Search depth, office action help and class selection vary by provider and often cost extra.
- Traditional hourly law firm: $550–$850 an hour, billed in 6-minute increments. Attorney of record, full advice. Total unknown until the work is done; office action responses often run $2,500–$5,000.
- NH Legal (flat fee): $899 comprehensive search with attorney analysis and a 30-minute consult; $1,699 plus USPTO fees to file; StartUp Trademark Package $3,999 plus USPTO fees; CEO Trademark Package $5,999 plus USPTO fees. Attorney of record. Price quoted before the work starts.
What the StartUp Trademark Package includes
- Two comprehensive trademark searches with attorney analysis and a 30-minute consult
- Trademark filing strategy
- Preparing and filing your USPTO application
- Representation throughout the process, with milestone reporting
- Every non-substantive office action response
- Post-registration support: proper use, maintenance and renewal deadline reporting
What is never included, at any provider
- USPTO fees: paid to the government, currently $350 per class of goods or services for a standard application, with surcharges for incomplete or free-form descriptions.
- Substantive refusals (for example likelihood of confusion or descriptiveness): at NH Legal these are quoted by the attorney after reading the refusal.
- Oppositions, cancellations and litigation: quoted on consultation.
Where the cheap option gets expensive
Most refusals come from two things a form cannot judge: a similar mark already in use (including unregistered, common-law use a basic database search misses) and goods and services described too broadly or in the wrong class. Fix either before filing and you avoid a response bill and, in the worst case, a lost filing fee and a rebrand.
Which one fits you
- Filing service: you already own a clearance opinion, the name is distinctive, and you are comfortable answering the USPTO yourself.
- Hourly firm: the matter is unusual or contested and you want open-ended counsel.
- Flat-fee attorney: you want a lawyer on record and a known number before you start.

Quick answers
Is an online trademark filing service cheaper than a trademark attorney?
Up front, usually. A do-it-yourself filing service typically charges about $199 to $350 plus USPTO fees. The cost shows up later if the application draws a refusal or was filed with the wrong goods, services or classes, because the filing fee is not refunded and the fix often needs an attorney anyway.
How much does a flat-fee trademark attorney cost?
At NH Legal, a comprehensive search with attorney analysis is $899, filing is $1,699 plus USPTO fees, and the StartUp Trademark Package is $3,999 plus USPTO fees, covering two comprehensive searches, filing strategy, the application, representation throughout and every non-substantive office action response.
How much does an hourly law firm charge for a trademark?
Traditional firms commonly bill $550 to $850 an hour in 6-minute increments, so the total is not known until the work is done. Office action responses at hourly firms often run $2,500 to $5,000.
Who is the attorney of record with a filing service?
With a do-it-yourself service you are usually filing for yourself, so no attorney represents you before the USPTO or answers the examiner for you. With a law firm, the attorney is the attorney of record and the USPTO writes to them.
Can any option guarantee my trademark will be registered?
No. The USPTO examiner and third parties decide. What changes your odds is a real clearance search before filing and a correct application.
